Spanish wealth tax in Andalucía starts above €3.7m net per owner in practice. See the 2026 thresholds, mortgage effect, filing rules, and worked examples.
The slogan that “Andalucía abolished wealth tax” is no longer a useful planning rule. Andalucía introduced a 100% regional rebate in 2022, but Spain’s subsequent large-fortunes levy changed the result. While the state levy remains in force, Andalucía replaces its blanket rebate with a variable rebate that leaves qualifying taxpayers paying broadly the amount produced by the state solidarity-tax calculation. The payment is collected through the wealth-tax return in Andalucía, rather than by charging the same amount twice.
For a non-resident owner, the practical payment threshold is usually €3.7 million of Spanish net wealth per person: the €700,000 exempt minimum plus the solidarity tax’s first €3 million zero-rate band. That is a payment threshold, not a filing threshold. A separate gross-assets test can force a return even where the amount due is zero.
⚖️ Three Numbers Decide Whether You File or Pay
Start with three thresholds. The first is the €700,000 exempt minimum available to non-residents taxed on Spanish assets. The second is the requirement to file when gross taxable assets and rights exceed €2 million, even if deductions and rebates eliminate the payment. The third is the practical €3.7 million net-wealth point at which the solidarity-tax calculation begins producing a positive amount.
The tax belongs to the individual, not the property. Two genuine 50/50 owners of a €5 million villa each report a €2.5 million interest. Each owner applies a separate €700,000 exempt minimum. Both may have a zero bill under the current Andalucía calculation, but each still has gross Spanish assets above €2 million and normally files separately.
🏛️ What Andalucía’s Rebate Actually Does
Andalucía’s original general rebate removed 100% of the regional wealth-tax charge. The current transitional rule is more precise. While the large-fortunes levy remains active, the general rebate is replaced by a rebate equal to the difference between the ordinary wealth-tax charge and the charge calculated under the solidarity-tax rules. The practical result is that the owner pays the solidarity-equivalent amount through Andalucía’s wealth-tax mechanism and avoids a second charge under the state levy.
Non-residents may use the rules of the autonomous community where the largest value of their taxable Spanish assets is located. A non-resident whose principal Spanish asset is a Marbella villa will generally point to Andalucía. This right now applies to non-residents generally; it is not limited to EU or EEA residents. The location and value of every Spanish asset must still be mapped before choosing the regional regime.
🏠 Value the Property Before You Discuss the Rate
Spanish real estate is not automatically reported at the owner’s preferred market estimate. For wealth tax, the starting value is generally the highest of three figures: the cadastral value, the value determined or verified by the tax administration for another tax, and the acquisition price or value. A low cadastral value does not rescue a villa bought for €5 million; the acquisition figure will ordinarily dominate.
The test is applied at 31 December. Completion date therefore matters. A buyer who signs a reservation agreement in November but completes in January does not own the property on the earlier 31 December. A buyer who completes on 30 December does. Cash still held in a foreign bank account is normally outside Spain’s territorial wealth-tax base for a non-resident, while the completed Spanish property is inside it.
Debt reduces the base only when it is legally and economically connected to the taxable Spanish asset. A mortgage used to acquire the Marbella property is the clean case. A personal credit line used to fund unrelated spending is not. Keep the loan agreement, completion statement, bank trail and year-end balance certificate. Without that chain, the deduction is an assertion rather than evidence.
Do not restructure ownership merely to chase an annual allowance. A gift of half a villa to a spouse can trigger gift tax, capital-gains consequences, notarial fees and registry costs. Company ownership adds accounting, corporate tax and beneficial-ownership reporting. The annual wealth-tax saving must be compared with the one-off transfer cost and the exit cost.
💵 Worked Example: One €5 Million Villa, Four Outcomes
Assume a non-resident owns no other Spanish assets, Andalucía is the applicable regional regime, the statutory value of the Marbella villa is €5 million, and no treaty changes the domestic result. The illustration excludes the joint income-and-wealth limitation because a non-resident’s foreign income position can alter that separate calculation.
The arithmetic is simple only after the ownership, valuation and debt facts are correct. For the debt-free single owner, €5 million less the €700,000 allowance produces a €4.3 million taxable base. The first €3 million is charged at 0%; the remaining €1.3 million at 1.7% produces €22,100. The mortgage case falls entirely inside the zero-rate band. The co-owner case applies the allowance and brackets separately to each genuine legal owner.
📋 Filing Calendar: The 31 December Snapshot Controls the Bill
Wealth tax is assessed on ownership at 31 December. It has no conventional tax period that averages balances across the year. The 2025 wealth-tax return was filed from 8 April to 30 June 2026; direct-debit payment required filing by 25 June. For the 31 December 2026 position, the 2027 campaign dates will be confirmed by the authorities, but owners should prepare before year-end rather than wait for the filing window.
Under Andalucía’s current mechanism, the regional wealth-tax return carries the effective charge and the Junta states that taxpayers covered by this reform do not also file the solidarity-tax return. The exact filing position should be checked where the owner has major assets in more than one autonomous community or where Andalucía is not the region with the highest taxable value.
🔍 Five Errors That Create Avoidable Assessments
- Use the statutory property value. Compare cadastral, tax-assessed and acquisition figures; report the highest applicable amount.
- Separate gross assets from net wealth. The €2 million filing test can apply before debt and the €700,000 allowance reduce the payment.
- Prove every debt deduction. Retain the loan deed, source-of-funds trail and year-end principal certificate.
- Allocate ownership correctly. Report legal title shares; do not divide an asset informally between spouses or family members.
- Run both tax calculations. Reconcile ordinary wealth tax, the Andalucía variable rebate and the solidarity-equivalent amount.
Mistake 1: treating the €2 million threshold as an allowance
It is not. The €2 million figure is a filing trigger based on gross assets and rights. The €700,000 figure is the exempt minimum used in the tax calculation. Mixing them produces either a missed return or an overstated bill.
Mistake 2: assuming a foreign company blocks Spanish wealth tax
Spain can tax interests in entities whose value is principally derived from Spanish real estate. Treaty language may change the result, but a company inserted between the owner and villa is not a universal exemption. It can also create annual corporate filings and a more expensive sale.
Mistake 3: deducting the original mortgage
The relevant figure is the qualifying outstanding principal at 31 December. Interest already paid, future interest and repaid capital do not remain as deductions.
Mistake 4: completing a restructuring without transfer-tax modelling
Moving half a property to a spouse may reduce annual exposure per owner, yet create immediate gift tax, capital-gains tax or municipal tax. Model ten years of annual savings against every upfront and exit cost before signing.
Mistake 5: planning in June instead of December
By filing season, the ownership and debt snapshot is already fixed. Review the position in November, document it on 31 December and file from a completed evidence pack.

The Spanish Tax Agency confirms that non-residents are taxed on Spanish-situs assets, may deduct qualifying charges and capital invested in those assets, receive a €700,000 exempt minimum, and are assessed on 31 December. The consolidated Wealth Tax Law gives all non-residents the right to apply the rules of the autonomous community where the highest value of their taxable Spanish assets is located.
The Junta de Andalucía states that, while the solidarity levy is in force, the former general rebate is replaced by the difference between the ordinary wealth-tax charge and the solidarity-equivalent charge. Its published 2025 campaign guidance confirms the filing window of 8 April to 30 June 2026 and the 25 June direct-debit cut-off. These are the correct starting points; private summaries that still say “100% wealth-tax-free in Andalucía” omit the operative transition.
